OrthoClear, Inc. Reports Successful North American Launch of its OrthoClearâ„¢ System; Announces Favorable Court Orders in Litigation with Align Technology

SAN FRANCISCO, June 14/PRNewswire/ — Today, OrthoClear, Inc., reported that its revolutionary orthodontic product – the OrthoClearâ„¢ System – has enjoyed a highly successful release since its North American launch on May 16, 2005.

“Since OrthoClear’s release in the marketplace, the response by those in the orthodontic community has been overwhelming. We are excited that doctors have responded so well to this advanced treatment modality and the benefits it delivers to their practice and patients,” said Company Chairman of the Board Peter Riepenhausen.

Since February 2005 the company has certified over a thousand of the nation’s leading orthodontists and dentists to treat with OrthoClear. “We are making every attempt to meet the demand of doctors who would like to be certified to use OrthoClear. In most markets there is a certification waitlist,” continued Mr. Riepenhausen.

Today, OrthoClear, Inc. also announced that in a suit pending in San Francisco County Superior Court, the Court awarded OrthoClear a victory over plaintiff Align Technology, Inc. (NASDAQ:ALGN). Upon OrthoClear’s challenge to Align’s complaint, the Court dismissed nine of the sixteen claims brought by Align, including Align’s claims of unfair competition, interference with prospective economic advantage, conversion, as well as unjust enrichment, and the Court specifically ordered Align to not re-file its conspiracy claim. Align has since amended its complaint to attempt to overcome the court’s ruling, but has completely dropped five of the dismissed claims. In a related proceeding, the Court ruled that OrthoClear could file an amended complaint with 23 claims against Align and its officers for their wrongful conduct, including unfair competition, defamation, and abuse of judicial process.

“While we believe this suit should not have been filed in the first place, we are pleased that the court has confirmed that these claims were deficient. As our successful launch has indicated, the attempts by Align to stifle healthy competition have not been and will not be successful. OrthoClear will continue to provide doctors with the most technologically advanced invisible orthodontics product on the market,” said Mr. Riepenhausen.
